Important Information on Buy To Let Mortgages

Regulation and Protection - Business BTL

We must bring to your attention the fact that any advice and recommendation that may be provided in respect of your business buy to let mortgage requirements is not regulated by the Financial Conduct Authority (FCA).

Your business buy to let mortgage will be deemed as ‘business’ as you are either buying or remortgaging a property which has been acquired with the intention of letting it out. 

In addition to business buy to let mortgages, there are other types of arrangements that are not regulated by the FCA. If you are unsure about your own requirements, please ask your adviser for further information.

This means that you will not receive the protection of the Financial Services Compensation Scheme (FSCS) and may not be entitled to refer any complaints to the Financial Ombudsman Service (FOS) should the need arise.

Disclosure

It is important the information you disclose is accurate. Should you proceed with an application for a business buy to let mortgage, the property against which the mortgage will be secured cannot be used as your own residence. If you intend to live in the property at any time, you must disclose this immediately to the lender.

Should you decide to live in a property funded with a business buy to let mortgage, you will be in breach of the conditions of that mortgage. This may result in the lender insisting the mortgage is repaid. You may also find it more difficult to secure a mortgage in the future.

We must bring to your attention the fact that any advice and recommendation that may be provided in respect of your consumer buy to let mortgage requirements is regulated by the Financial Conduct Authority (FCA).

Your consumer buy to let mortgage will be deemed as ‘consumer’ status, due to the property you intend to mortgage being:-

·         a property which you purchased as your main residence, but you now intend to let out, or

·         a residential property which you have inherited and intend to let out

This means that you will not receive the protection of the Financial Services Compensation Scheme (FSCS) but will be entitled to refer any complaints to the Financial Ombudsman Service (FOS) should the need arise.

In addition to consumer buy to let mortgages, there are other types of mortgage which are regulated by the FCA. If you are unsure about your own requirements, please ask your adviser for further information as it is important that you receive the correct advice.

This may result in the lender insisting the mortgage is repaid. You may also find it more difficult to secure a mortgage in the future.
